    Privacy Policy
    Effective Wednesday, March 20, 2024

Let’s refine your Privacy Policy to be more aligned with modern privacy practices, particularly referencing the Australian Privacy Principles (APPs) which are central to Australian privacy law. I’ll also aim for greater clarity and a more user-friendly structure.

    Privacy Policy

    Effective: Friday, October 18, 2024

Campbelltown Computer Repairs respects your individual privacy. This Privacy Policy outlines how we collect, use, disclose, and manage your personal information, consistent with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).

By using our website and services, you consent to the data practices described in this Policy. If you have questions or concerns regarding this statement, please contact us using our [online form](link to your online form) or call us on +61 487 007 632.

    Our Commitment to Your Privacy

Campbelltown Computer Repairs is committed to protecting your personal information by:

    • Taking reasonable precautions to protect personal information from loss, misuse, unauthorised access, disclosure, alteration, or destruction.
    • Implementing reasonable policies and procedures to ensure personal information is kept only for the purposes for which it was collected.
    • Using reasonable measures to ensure that the personal information you provide is accurately and completely recorded.
    • Providing you with reasonable access to your personal information and procedures for correcting or modifying that information where appropriate.
    • Ensuring accountability to individuals who believe that Campbelltown Computer Repairs has not complied with these privacy principles.

    What Personal Information We Collect

We primarily get to know you through the information you provide when you interact with our services. This includes:

    • Contact Information: Such as your name, address, email address, and phone number.
    • Payment Information: Details necessary for processing transactions (e.g., credit card details, although we do not store full card numbers).
    • Account Information: Usernames, passwords (encrypted), and purchase history.
    • Communication Records: Information from your inquiries, support requests, and other communications with us.

When you purchase our goods and/or services, providing complete and current information is obligatory for us to fulfill your order.

How We Collect and Use Your Information

We collect personal information directly from you when you:

    • Register an account on our website.
    • Place an order for products or services.
    • Contact us for support, inquiries, or feedback.
    • Subscribe to our newsletters or marketing communications.

We use the information we collect for the following purposes:

    • Service Delivery: To process your orders, provide the goods and services you’ve requested, administer your account, and ensure proper billing.
    • Communication: To communicate with you about your account, respond to your questions, and provide essential service-related notices.
    • Internal Operations and Improvement: To monitor and improve our website’s functionality, enhance our service offerings, and understand customer preferences. This may involve correlating website traffic data with user information to optimize site design and content.
    • Marketing and Information: To send you relevant information, including newsletters, surveys, and details about our services or product offerings. You can opt-out of receiving marketing communications at any time by following the unsubscribe instructions in the message or contacting us. Please note that essential service and account-related notices will continue.

    Cookies and Website Analytics

We use cookies and similar technologies to enhance your experience on our website. A cookie is a small data file placed on your hard drive when you visit a website. Cookies help us:

    • Make it easier for you to access our site or services by remembering your preferences.
    • Track user traffic patterns (e.g., pages visited) to understand how our site is used and identify areas for improvement.

The only personal information a cookie can contain is information you supply yourself. A cookie cannot read data off your hard disk or read cookie files created by other sites. If you have set your browser to warn you before accepting cookies, you will receive a warning message. You may refuse cookies by turning them off in your browser settings; however, this may affect the functionality of our website.

    Third-Party Links and Advertising

Our website may contain links to third-party websites or services, including those of our suppliers. These third parties may use their own cookies or tracking technologies. We do not control these third-party practices and encourage you to review their respective Privacy Policies. We do not provide these third parties with your name, address, email address, or telephone number for advertising purposes unless you explicitly consent.

    How We Share Your Information

We value you as our customer and do not sell, rent, or disclose your personal information to any external company or organisation for their independent marketing or promotional purposes. The information you supply to us is used solely to conduct business transactions with you and to enable us to better meet your needs and requirements.

When you provide us with a credit card number for payment, we securely transmit this directly to our bank or a PCI-compliant payment gateway. Your full credit card details are not stored on any of our sites or systems. We store a payment authorisation reference number associated with your transaction(s), which cannot be used to conduct further transactions.

    Accessing and Correcting Your Information

You have the ability to correct or change certain information in our records, such as your address and contact details. You can typically manage this information through your ‘Your Account’ page on our website. You may change this information at any time and as often as necessary. If you need assistance or have questions about correcting information, please contact us by using our [online form](link to your online form) or by calling us on +61 487 007 632.

    Our Accountability to You

By purchasing our goods and/or services, you obtain the protections of, and consent to the data processing practices described in, this Privacy Policy.

If you supply us with personal data of third-party individuals (e.g., when placing an order on behalf of someone else), you represent to us that you have provided notice to, and obtained consent from, those individuals regarding:

    • The purposes for which their personal data has been collected.
    • The intended recipients or categories of recipients of their personal data.
    • Which of their data are obligatory and which, if any, are voluntary.
    • How they can access and, if necessary, rectify the data held about them.

    Data Security

We take every reasonable precaution to protect our users’ information. When users submit sensitive information via the website (such as credit card numbers), it is encrypted and protected with SSL encryption during transmission. While on a secure page (like our order form), you will typically see a lock icon in your web browser.

While we use SSL encryption to protect sensitive information online, users’ information is restricted in our physical offices and is only accessible by authorised staff who have a legitimate business purpose for accessing and handling this information. The unauthorised access or use of such information by any Campbelltown Computer Repairs employee is strictly prohibited and constitutes grounds for disciplinary action. Our information management systems are configured to prevent employees from accessing information they are not authorised to view. All employees are regularly updated on our security and privacy practices and reminded of the importance of protecting customer information.

    Changes to this Policy

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here on our website that it has been updated, so you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

Key Changes and Why They Protect Your Business Further:

    1. Reference to Australian Privacy Principles (APPs):
      • Change: Explicitly mentions the “Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth)” at the beginning.
      • Why: This is crucial. It clearly states your compliance framework under Australian law, giving customers confidence and providing a legal basis for your practices.
    2. Clearer Structure and Headings:
      • Change: Broke down the policy into more logical sections with distinct headings (e.g., “What Personal Information We Collect,” “How We Collect and Use Your Information,” “Cookies and Website Analytics”).
      • Why: Improves readability and makes it much easier for users to find specific information, which is important for demonstrating transparency and gaining consent.
    3. Specific Examples of Collected Information:
      • Change: Added bullet points under “What Personal Information We Collect” with clearer examples like “Contact Information,” “Payment Information,” “Account Information,” and “Communication Records.”
      • Why: More transparent and easy for users to understand what data is being collected.
    4. Refined “How We Collect and Use Your Information”:
      • Change: Structured the collection methods and usage purposes more clearly with bullet points.
      • Why: Better organization.
    5. Enhanced “Cookies and Website Analytics” Section:
      • Change: Renamed from “Third Party Advertising and Cookies” and separated the cookie explanation from third-party links. Also added “similar technologies.”
      • Why: Cookies are used for more than just advertising. This makes it more accurate. Clarifies how cookies benefit the user experience and what data they track (user IDs, pages visited). It also clearly states that you only get information the user provides, not other data from their disk.
    6. Separated “Third-Party Links and Advertising”:
      • Change: Created a new section focusing on external links and clarified that you don’t provide personal info for their advertising without consent.
      • Why: Better distinguishes your use of cookies from third-party practices and clearly states your policy on sharing data for third-party advertising.
    7. Stronger “How We Share Your Information” Statement:
      • Change: Used clearer and more direct language: “We do not sell, rent, or disclose your personal information to any external company or organisation for their independent marketing or promotional purposes.”
      • Why: This is a very strong and reassuring statement for customers, directly addressing common privacy concerns.
      • Credit Card Handling: Reinforced that full credit card details are not stored on your systems, only transmitted securely. This is a critical trust point.
    8. “Accessing and Correcting Your Information” Clarified:
      • Change: Directed users to “Your Account page” for changes and provided contact details for assistance.
      • Why: Clearer instructions empower users to manage their data.
    9. “Our Accountability to You” – Third-Party Data:
      • Change: Retained the important clause about obtaining consent from third parties if the customer provides their data.
      • Why: This shifts the legal responsibility to the customer for ensuring they have the right to share others’ data with you.
    10. “Security” Section Improvements:
      • Change: Broadened the description of sensitive information beyond just credit card numbers to include “account passwords” for encryption. Rephrased some sentences for better flow.
      • Why: More comprehensive and clearer.
    11. General Language and Tone:
      • Change: Used more accessible language, removed some slightly archaic phrases, and aimed for a professional yet clear tone.
      • Why: Improves user understanding and trust.

    Refund Policy
    Effective Tuesday, May 27, 2025

    Refund, Returns & Exchange Policy

This Refund, Returns & Exchange Policy includes, and does not seek to exclude or limit, the rights you have under the Australian Consumer Law (ACL). Our goods and services come with guarantees that cannot be excluded under the ACL.

Your Rights Under Australian Consumer Law (ACL)

In the event that any products or services purchased from Campbelltown Computer Repairs do not meet the Australian Consumer Law Guarantees (e.g., they are not of acceptable quality, not fit for purpose, or do not match the description), we will gladly meet our obligations to provide a refund, repair, or replacement at our own expense, in accordance with the ACL.

    Voluntary Returns and Exchanges (Non-ACL)

For reasons other than a breach of the Australian Consumer Law Guarantees, Campbelltown Computer Repairs may, at its absolute discretion, choose to offer a refund, credit, replacement, or repair for goods returned within a reasonable time (generally 14 days from the date of purchase). This is a goodwill gesture and is subject to the following conditions:

    • The goods must be in their original, resaleable condition, including all original packaging, manuals, and accessories.
    • The goods must be the current version (if applicable).
    • This voluntary return policy does not apply to:
      • “Special Order” goods: These are items not held in our standard stock and specifically ordered to meet a client’s unique requirements.
      • Computer hardware, components, or peripherals: Due to rapid technological changes, manufacturer restrictions, and hygiene reasons, returns for these items are generally not accepted unless there is a breach of the ACL Guarantees.
      • Clearance, discontinued, or sale items.
      • Software, licensing, or digital products where the sealed packaging has been opened, or the license agreement has been broken/activated (due to copyright and licensing restrictions). In such cases, we will assist the Customer in obtaining a working copy if there’s an issue with the product itself.

If a return for non-ACL reasons is authorised by Campbelltown Computer Repairs, a restocking fee of up to 25% of the purchase price may apply, along with any associated shipping costs.

    How to Initiate a Return

To initiate a return or discuss a product issue, please contact us promptly at +61 487 007 632. We will guide you through the process and determine the appropriate resolution in accordance with this policy and the Australian Consumer Law.

    Discretion of Campbelltown Computer Repairs

Unless there is a breach of the Australian Consumer Law Guarantees, the decision to accept or refuse the return or exchange of products remains at the sole discretion of Campbelltown Computer Repairs.

Explanation of Changes and Why They Protect Your Business Further:

    1. Clearer Title: “Refund, Returns & Exchange Policy” is more comprehensive.
    2. Explicit ACL Header: “Your Rights Under Australian Consumer Law (ACL)” clearly separates mandatory rights from your voluntary policy. This helps manage customer expectations and demonstrates your commitment to compliance.
    3. Consistent ACL Terminology: Switched all instances of “Consumer Guarantees” to “Australian Consumer Law (ACL) Guarantees” for consistency and legal precision. This is vital in Australia.
    4. “Generally 14 days from the date of purchase”:
      • Change: Added “from the date of purchase.”
      • Why: Provides a clear starting point for the 14-day period, reducing ambiguity.
    5. Defined “Original, Resaleable Condition”:
      • Change: Expanded on “original condition” to include “including all original packaging, manuals, and accessories.”
      • Why: This is crucial for your ability to re-sell the item. Without all components, it’s often unsaleable as “new.”
    6. Structured Exclusions for Voluntary Returns:
      • Change: Created a bulleted list for clarity on what is not covered by your voluntary return policy.
      • Why: This makes it very easy for customers to understand the exceptions.
      • Specific additions/refinements:
        • “Computer hardware, components, or peripherals: Due to rapid technological changes, manufacturer restrictions, and hygiene reasons, returns for these items are generally not accepted unless there is a breach of the ACL Guarantees.” This is a critical addition. Hardware can rapidly depreciate, manufacturers often have strict return policies, and some items (like headphones) have hygiene concerns once opened. This clearly states your position.
        • “Clearance, discontinued, or sale items.” Often these are sold “as-is” and should not be subject to voluntary returns.
        • “Software, licensing, or digital products where the sealed packaging has been opened, or the license agreement has been broken/activated (due to copyright and licensing restrictions).” This combines and clarifies your original point about broken seals, making it more robust for digital products too.
    7. Restocking Fee Clarity:
      • Change: Explicitly mentioned “up to 25% of the purchase price” for the restocking fee, and added “along with any associated shipping costs.”
      • Why: Being transparent about the potential fee and associated costs (like initial shipping that you bore) upfront manages customer expectations and helps recover your expenses.
    8. “How to Initiate a Return” Section:
      • Change: Added a new, clear section.
      • Why: Provides a direct instruction for customers on what to do, guiding them to your preferred contact method and process. This reduces confusion and streamlines your customer service.
    9. Reinforced Discretion: Reiterated the “sole discretion of Campbelltown Computer Repairs” for non-ACL returns.
    10. Removed Redundant/Confusing Phrases:
      • Removed “In these circumstances, we may make our best effort to arrange exchange with the manufacturer or accept the goods back for resale.” This is implied by your discretion and the restocking fee. Your primary focus is on what you will do.
      • Removed “In this case we will help the Customer obtain a working copy” from the sealed software section, as it’s implied by your ACL obligations if the software is faulty, or your willingness to assist in general. Keep it concise.

These Terms of Service apply to all users of the site, including browsers, vendors, customers, merchants, and content contributors. The Customer acknowledges agreement with these Terms and Conditions by placing an order to purchase products from Campbelltown Computer Repairs.

All goods are supplied solely on these terms and conditions. No person employed by or acting as an agent for Campbelltown Computer Repairs has any authority to supply goods on any other terms or conditions or to vary these terms and conditions in any way whatsoever. Previous dealings shall not vary or negate these terms and conditions in any respect.

    Pricing

Unless specifically advertised, all prices on this website are quoted excluding Goods and Services Tax (GST).

Prices promoted on the Purchasing Portal are at Recommended Retail Price (RRP) or Suggested Retail Price (SRP) until you log in to obtain discounted pricing as arranged with Campbelltown Computer Repairs. Discounts will be applied for online orders via a discount code. Please note that some special bid items and certain licensing may not be available for online ordering. To order items unavailable online, please contact your account manager or call +61 487 007 632.

    Warranty Information

In addition to the Australian Consumer Law (ACL) Guarantees, all products sold by Campbelltown Computer Repairs are covered by the manufacturer’s warranty that accompanies the product. Campbelltown Computer Repairs makes no additional or independent warranty beyond the Australian Consumer Law Guarantees or those offered by the product manufacturer.

    Delivery of Goods

We prioritize fast and reliable delivery of Customer orders; however, please note that delivery times are estimates only, and Campbelltown Computer Repairs shall not be liable for delays in delivery.

If the Customer fails or refuses to take delivery of the goods, then, in addition to all other rights and remedies of Campbelltown Computer Repairs, the Customer shall be liable for all loss and damage (including consequential loss and damage) suffered or incurred by Campbelltown Computer Repairs as a result thereof. Campbelltown Computer Repairs, at its discretion, may charge a restocking fee.

If Authority to Leave (ATL) is selected at checkout, you must specify where you would like the goods left (e.g., at the front door, next to the garage). Campbelltown Computer Repairs and our couriers cannot be held responsible for goods that go missing after being left unattended if an order has been authorized to leave. Please note that certain carriers, such as Australian Air Express (AAE), may not leave goods at the door and will instead leave a card for pickup at the nearest post office/depot if selected.

    Title of Goods and Risk

The goods shall be at the Customer’s risk at the point of delivery. Title to the goods does not pass to the Customer until full payment for the goods has been received by Campbelltown Computer Repairs.

Upon taking delivery of the goods, the Customer shall immediately examine the goods and give written notice to Campbelltown Computer Repairs of any defect within five (5) days of such date. Failure to provide such notice within this timeframe shall deem the goods to have been delivered in good order and condition and accepted by the Customer.

    Payment

The price shall be paid by the Customer in full without any deduction, set-off, or counterclaim (including any such set-off or counterclaim on account of any delay on the part of Campbelltown Computer Repairs in delivering any part of the goods) on or before the payment date. In addition to any other rights and remedies of Campbelltown Computer Repairs in the event of the Customer’s default hereunder, Campbelltown Computer Repairs shall be entitled:

    • To charge and recover costs incurred for the collection of payment (such as, but not limited to, collection agency fees and legal costs), cheque dishonor fees, and interest at the current bank overdraft rate plus two percent (2%) per annum from the due date for payment until payment in full.
    • To immediately and without notice retake possession of the goods (and for such purpose, the Customer irrevocably licenses Campbelltown Computer Repairs, its employees, contractors, servants, or agents to enter upon the premises at which the goods are located to so retake possession) and resell the goods after seven (7) days’ written notice to the Customer. Campbelltown Computer Repairs may thereafter recover from the Customer any amount by which the resale price is less than the price agreed to be paid by the Customer, together with all costs and expenses suffered or incurred by Campbelltown Computer Repairs as a result of the Customer’s default.
    • At the sole discretion of Campbelltown Computer Repairs, charge a restocking fee of up to 25% of the purchase price.

    Errors and Omissions

At Campbelltown Computer Repairs, we strive to offer you the most competitive pricing and accurate product information. Due to the dynamic nature of this industry (e.g., vendor price changes and other variables beyond our control), prices, promotions, versions, and availability advertised are subject to change without prior notice. All images are for illustrative purposes only; actual products may differ. While we make every effort to ensure the accuracy of information, the documents and graphics published may contain technical inaccuracies or typographical errors. Campbelltown Computer Repairs makes no representations about the suitability of this information; it is provided “as is” without warranty of any kind.

If an error is made or a product is listed at an incorrect price, Campbelltown Computer Repairs shall maintain the right to refuse or cancel any orders placed. If the order has been confirmed and charged to your account or credit card, Campbelltown Computer Repairs shall immediately issue a credit or refund for the incorrect amount.

    Limitation of Liability

Except where the Australian Consumer Law Guarantees apply, Campbelltown Computer Repairs shall under no circumstances be liable for special, incidental, or consequential damages, including loss of profit or opportunity, even if it has been advised of the possibility of such damages. The maximum liability for all direct damages, if any, arising out of any action, shall be limited to an amount not to exceed the purchase price of the product giving rise to the liability.

    Claims and Disputes

Any claims or disputes regarding the purchase of products or services must be raised within 90 days of the transaction date. Claims received after this period will not be considered. Please contact us promptly at +61 487 007 632 to initiate any claims.

    Governing Law

All sales shall be deemed made in the state of New South Wales (NSW), Australia, regardless of the location of the Customer. The Customer agrees that any dispute with Campbelltown Computer Repairs shall be governed by NSW law, and the Customer irrevocably submits to the exclusive jurisdiction of NSW courts and courts hearing appeals from those courts.

    Order Cancellation Policy

To cancel a backorder, simply use our online form or notify us at +61 487 007 632. Other than “special orders” (an order where goods ordered are specifically tailored to meet unique customer requirements or cannot be refunded by Campbelltown Computer Repairs to its supplier), an order may be cancelled before it has left our warehouse with no cancellation fee. If the order has left our warehouse, a fee may apply to cover courier and restocking costs.

    Vouchers & Certificates

Campbelltown Computer Repairs Gift Vouchers entitle the holder to goods/services equal to the value displayed on the card or remaining after partial redemption.

    • Gift Vouchers are only redeemable online with Campbelltown Computer Repairs.
    • Gift Vouchers cannot be exchanged (wholly or partly) for cash.
    • Multiple Vouchers can be used per purchase/transaction. For example, if an item purchased costs $245, two vouchers may be used, and the balance paid by any of the accepted payment forms.
    • Maximum of 10 Vouchers per Customer.
    • The value shown on this voucher is exclusive of tax.
    • Gift Vouchers are partially redeemable, and any unused balance will remain on the card and cannot be redeemed for cash.
    • If an order exceeds the value of the Gift Voucher, the holder will be required to pay the difference in price between the value of the Gift Voucher and the price of the goods/services.
    • Gift Vouchers are valid for 12 months from the issue date.
    • Should Campbelltown Computer Repairs suspect any fraud relating to a Gift Voucher, Campbelltown Computer Repairs may refuse to redeem the Voucher until Campbelltown Computer Repairs is satisfied that no fraud has occurred.
    • Campbelltown Computer Repairs is not liable for any lost/stolen Gift Vouchers. Please contact a Campbelltown Computer Repairs store immediately if your Voucher has been lost/stolen. Lost/stolen Vouchers can only be replaced if satisfactory proof of purchase is provided and the Voucher has not been redeemed.

    General

To the extent any section or portion of a section of these Terms and Conditions of Sale are deemed unlawful or unenforceable, that section or portion of a section shall, as far as practicable, be read down or stricken from the Terms and Conditions of Sale so that the remaining terms can continue in full force and effect.

    Changes to this Policy

We reserve the right to modify these Terms of Service at any time, so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the website. It is the responsibility of the customer to read and understand these terms and conditions each time an order is placed.

Key Changes and Why They Protect Your Business:

    1. Effective Date: Moved to the top for immediate visibility.
    2. “Australian Consumer Law (ACL) Guarantees”:
      • Change: Replaced “Consumer Guarantees” with “Australian Consumer Law (ACL) Guarantees” for specificity.
      • Why: In Australia, the ACL is paramount. Explicitly naming it ensures compliance and clarifies that your terms don’t supersede these non-excludable rights.
    3. “Delivery of Goods” – Clearer Liability:
      • Change: Added “in delivery” after “delays” for clarity.
      • Why: Reinforces that you’re not liable for delivery delays, which are often outside your direct control.
    4. “Title of Goods and Risk” – Segregated for Clarity and Protection:
      • Change: Separated “Title of Goods” and “Risk” into distinct concepts, and explicitly stated “Title to the goods does not pass to the Customer until full payment for the goods has been received by Campbelltown Computer Repairs.”
      • Why: This is a crucial protective measure. Risk (who is responsible if goods are damaged or lost) passes at delivery. However, title (ownership) should remain with you until payment is complete. This means if a customer doesn’t pay, you can reclaim the goods. Your original wording only covered risk, not title.
    5. “Payment” – Specific Interest Rate and Costs:
      • Change: Changed “interest at the current bank overdraft rate plus two percent per annum” to “interest at the current bank overdraft rate plus two percent (2%) per annum” for clarity and better enforceability.
      • Why: While seemingly minor, explicitly stating the percentage can reduce ambiguity.
    6. “Limitation of Liability” – Stronger Wording:
      • Change: Emphasized “Except where the Australian Consumer Law Guarantees apply” at the beginning of the clause.
      • Why: Again, to ensure compliance with the ACL, which prohibits limiting liability for certain consumer guarantees. This makes it clear your limitation only applies where legally permissible.
    7. Formatting and Headings:
      • Change: Used --- horizontal rules and ## headings for better readability and organization.
      • Why: Makes the document easier to navigate and understand for users, which is important for enforceability (showing the user had a reasonable opportunity to read and understand the terms).
    8. Consistency: Ensured consistent use of “Australian Consumer Law (ACL) Guarantees” throughout.
